Needs to engage Fremer as the expert witness to prove that the additional 1 more digital step is audible and detrimental to biological and mental health.

Bursor & Fisher is the law firm that popped up in my Facebook feed with the sponsored ad asking for those affected by "The MoFi Predicament". Not looking good for the defendant is an understatement. Tomorrow is their official deadline to respond to the case filed in Washington, which I can only assume was met. Now the defendant has until September 8th to respond to this filing.
WBF will be printing scorecards soon so members can keep up with all the activity
Michael Fremer needs to be deposed if the cases aren’t dismissed because he doesn’t want to be deposed. He will have answer hard questions and may find himself saying things under oath that he would prefer not to. I’ve met Michael several times but as I’ve said many times publicly if you supported MQA and Michael did, the hobby would be better off without you.
Why is there a distain for mqa ?
as for M.F he is an important fixture in vinyl and this Carrie’s observations that not all will agree. The trouble in analog is and continues to be a real agreement on methods to judge sound.
why is M.F needed at all on this is he the god to answer to all of us ?

Whether MoFi DSD vinyl is a good product and/or can be distinguished from a clean analogue-era 1st issue is moot.
The pain at the heart of the matter is that, in order to enjoy authentic analogue musical experiences for their very own sake - regardless of strict SQ arguments - I may have wanted to avoid scraping my expensive cartridge across digits stamped on plastic ... but have been hoodwinked into spending hard-earned money doing exactly that, nervertheless.
[Actually I wasn't a victim as nearly all my vinyl is pre-digital, but that is incidental.]
I would like to see MoFi lose a law suit - not so much to establish (difficult-to-quantify) damages for plaintiffs in a class action - but to clean up the stink in the industry and restore consumer confidence.
I'm intrigued, with absolutely the greatest respect towards @Rt66indierock, that he seems to have taken the side of the shysters in this matter.

the point I’m making is an experienced person like MF has virtues most can’t hear even if his hearing is not like a deaf 25 year old
Be careful what you wish for. You could be ruled Fruit Loops by the court, e.g., someone who is silly or strange. Part of who is a reasonable consumer comes from a Fruit Loops cereal case.
And if what Michael Fremer and I know about the condition of master tapes ever becomes public. There will a lot of sad people.
I’m only interested in what consumer law is in the Nineth Circuit Court of Appeals in the United States. I’m going to push the topic of what is a reasonable consumer until the horse is dead and the vultures pick the bones clean. Then move on to the next problem the plaintiffs have in these cases.
I came up with case law to dismiss these cases, laid up with a badly sprained ankle and my iPhone. Think of what I can do at the office with real tools.

I hear you - that you have doubts about the legal credentials of the plaintiffs.
I am no lawyer (but then nor are you?) - far less any expert on US legal precedents of any kind - but I do see on this very page evidence of money expended on class recruitment. The swelling of indignation at large, moreover, might/must land somewhere.
Not sure how to read your love letter! You refer tongue-in-cheek to audio consumer causes at large? Or imply that one man shouldn't stretch his ambitions ...
For me - I love my records. I love them because they are of their time. I have as many CDs as records. But the latter are for my education and my convenience. What I am saying is that I would listen to Jazz on shellac. Led Zepp. on era-congruent vinyl. If I could think instantly of a modern artist I liked, I would listen to a CD or a download. I own maybe a dozen MFSL LPs - likely all pre-digits. If I had bought any MoFi vinyl reissues since c. 2007, and only now discovered their DSD-infection, I'd want recompense of the moral kind. MoFi should pay a fitting price by losing a legal case so that the probability of providers sharking consumers in the future is constrained. I don't accept that people like me - a reasonably well-informed music lover - should have discerned anyway that MoFi records as they were marketed were not AAA. The folly argument should be tested - at least.
