Say what you will about YouTube videos and the opinions shared within them. Videos like this play a vital function by making audiophiles aware of little-known brands that do not enjoy the BIG brand's massive ad budgets and broad retail distribution networks. This is a valuable and necessary service for discovering excellent products like Tobian.
Yes, audio dealers sure love these videos, personally i have put the Greek and Jay and their videos on ignore on every platform i frequent. Life is just to short for watching this kind of salesmanship.

The cost of vegetable soup in Geneva
The inability of a waiter in Basel to laugh
The provenance of the pictures hanging in the Kunstmuseum
The traffic at San Gottard
Christian Gross
The chocolate (my wife's Belgian - they know how to make decent chocolate)
It's just far too clean, it makes me nervous

I had a pair of Tobians on trial. While they do sound good i found them unbearably shouty. And another small issue is that Tobian refuse to take them back having agreed to do so before purchase. So dont but Tobian until you have heard them first! No dealer in my country so i didnt have that option
Can you comment on what you have tried to reduce the shouty quality (angle, toe in, room treatments - I have no idea since I've never heard them)? Perhaps you can seek out owners on WBF who can make further suggestions that are worth trying. Perhaps you can make lemonade out of the lemons.
That said, it is lousy that the owner made a commitment and then reneged. He made the right decision the first time. If you paid for shipping and the speakers are in good condition, why can't he clear up the misunderstanding with a holiday gesture?
I'm finding this decidedly one-sided from two points of view. Let me state I have no commercial interest in Tobin. On returns, as a speaker manufacturer, we would never take back ex-demo stock, allowing a customer a trial. On new, only in cases where we had no dealership, confirmed the customer complete system components (I do not see yours listed), room size, general acoustics, and listening preferences.
Shame on them if Tobian did not go through this process to determine the likelihood of success. Conversely, I would say you have responsibility if you did not have the terms confirmed in writing and confirmed again with Guenther before paying for an ex-demo product. Most folks I know would insist the return policy be written on the face of the invoice.
You did have an option. Hop on an airplane to visit Tobian (tickets are cheap on intercontinental flights as inexpensive insurance against making what I presume was a 30-40k euro purchase.
As for sound, the Tobians are superb speakers. In my experience, they have never sounded anything but balanced, dynamic, and enjoyable. Shouty lies elsewhere in the chain. My observations come from extensive listening sessions in at least three environments with both tube and solid-state amplification. The one constant was cabling from Final Touch Audio and various Lampizator DACS, from the humble USD 4k Amber to the penultimate Horizon DAC.
Lastly, I agree with some other members that WBF is not the place to torch a manufacturer without having written documentation to back it up. Enough said.
If it's a real email, show the entire thing. Otherwise your "proof" is just a made up email you just typed up and took a screenshot of just now.
A newbie trashing a company with no proof and now trying to play legalities. Sounds like one of those questionable customers - or maybe even shills Ron was talking about? - we always hear about.
Not a good look for you.
Also since you like law so much, I'm sure you've aware of the possible legal repercussions you've opened yourself up to by your posts.

Perhaps @Synaxis could offer you what listening distance and rake angle he uses. As well as where he points the horn. e.g. outside the shoulder, at the shoulder, inside the shoulder etc. If you sit farther away than Synaxis then you would rake them back a little more. If you sit closer then rake them forward a little more. These would at least get you an idea of where to go.
Oh boy. Yep okay Merry Christmas. No hate and you truly are over reacting asking a question is not a snide remark it is a question. And to you good day sir.
