Buying gear from a garage operation

Amir, sorry to hear about your problems with Tact.
I looked up their web page and found this:
"Tact manufactures its hardware products from parts and components that are new or equivalent to new in accordance with industry-standard practices. Tact warrants that the hardware products it manufactures will be free from defects in materials and workmanship.

The limited warranty term is two years beginning on the date of invoice, as further described in the following text.
Damage due to shipping the products to you is covered under this limited warranty. Otherwise, this limited warranty does not cover damage due to external causes, including accident, abuse, misuse, problems with electrical power, servicing not authorized by Tact, usage not in accordance with product instructions, failure to perform required preventive maintenance, and problems caused by use of parts and components not supplied by Tact.
This limited warranty does not cover any items that are in one or more of the following categories: software; external devices (excepted as specifically noted); accessories or parts added to a TacT system after the system is shipped from Tact; accessories or parts that are not installed in the Tact factory.

During the two-year period beginning on the invoice date, Tact will repair or replace products returned to Tact's facility. To request limited warranty service, you must contact Tact 's Customer Technical Support within the limited warranty period. Refer to your documentation to find the appropriate telephone number for obtaining customer assistance. If limited warranty service is required, Tact will issue a Return Material Authorization Number. You must ship the products back to Tact in their original or equivalent packaging, prepay shipping charges, and insure the shipment or accept the risk of loss or damage during shipment. Tact will ship the repaired or replacement products to you freight prepaid if you use an address in the continental United States, where applicable. Shipments to other locations will be made freight collect.

GENERAL

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION). TacT'S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS LIMITED TO REPAIR AND REPLACEMENT AS SET FORTH ABOVE IN THIS LIMITED WARRANTY STATEMENT. ALL EXPRESS AND IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXCLUDED.

TACT DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH ABOVE IN THIS LIMITED WARRANTY STATEMENT OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST DATA OR SOFTWARE. SOME STATES (OR JURISDICTIONS) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU.

You accept full responsibility for your software and data. TacT is not required to advise or remind you of appropriate backup and other procedures."

Two things that jump out at me are..1) You had a two(2) year warranty from Tact from the time of purchase....presumably your travails started after the two year window..:( and 2) the last sentence would indicate that the warranty does not cover your software, doesn't seem to indicate an issue with covering their software:confused: Although the fourth paragraph might indicate that:confused:
I'm always a little surprised when a Co., big or small, fails to realize that if you are having a problem with their product and that problem is not necessarily tied to age or use, but more to the failure of design; that it would be a VERY good business practice to assist their customer as much as possible with said problem.
I had a similar problem with my MBZ a couple of weeks ago, just one month out of warranty on the timeline and with very low miles, the car develops a problem that is connected to a valve timing issue that is clearly a manufacturer design fault...My ex-dealer and MBZ couldn't give a damn.:mad:
Since I have owned this make for over 20 years, I now will most likely discontinue my association with them for my next vehicle...Very simple solution.

Thanks Dave. I had not read that and it is interesting that the note the software not being covered with any kind of warranty. Let me be clear that the problem right now is that he is not able to fix the product regardless of the cost. While such things do occur in hardware manufacturing, it happens farther down the road than the few years I have owned this box post upgrade.

I guess the most frustrating thing is that I know he can help resolve this issue but it simply is not a priority for him. Surely he has at least one working unit in his shop and could send me the one module to see if it works. And then rework mine and get it working again.

Shows that engineers can indeed be poor business people!

Before buying from a garage operation I would very closely look at who will be running the company if the head engineer retires, dies, or takes off on a long trip once he cashes the check you sent for your deposit.

That is rather harsh response with no viable solution offered, and more than anything suggests a struggling operation short on resources (be it time, cash, parts or know-how, doesn't matter).

I thought the classic engineer who was also a good businessman was the exception, not the rule! :p

That's the bigger problem with audio being very much a hobbyist and cottage-type industry... Delivering a few products isn't a problem. Delivering them in quantity, consistently, and sustainably takes greater business awareness than the creation of an item.

I just got a whole set of electronics from a company that the owner says has exactly 2 and a half employees. Great sound and impeccable point to point wiring. Funny how this coincides with Charlie Sheen's meltdown, no? They are the Bee's Knees (Not Charlie and company). Many thanks to the WBF member that pointed that company out. Yeah, you know who you are. Thanks man!
