I heard about that case on NPR. I can't say I understand the argument the judge is using, but I didn't look in to it more. The same day I read that judges can and often do overturn prenuptial agreements. I've heard of other contracts being judged illegal, so nothing new there.

A judge should follow the law nothing else. Easier said than done. As someone who argued several cases on all levels, the law can be vague or unclear. Many judges think they are following the law but their view can be clouded by their own bias. It happens both with judges that are liberal, conservative or the so called strict constructionists that really aren’t. Technology and situations change and often these changes couldn’t have been foreseen when the law was written. This stuff is more complicated and nuanced than many think.

Does it bother anybody as a privacy rights matter that it is easier for the government (only upon law enforcement request, of course ) to use electric vehicles to track you than it is to use internal combustion engine vehicles to track you?
