just venting here, but if you have a suggestion - pls feel free to butt in

My 2 sisters (one from Phoenix one from the Phils) came over to visit our 86 yr old mother (who is staying with me here in Canada). They both wanted to see Vancouver and Victoria, British Columbia so I volunteered to drive them. It was a great trip, we were so happy to do this trip because this is the first time we actually went for a vacation where it was just the 3 of us and without our spouses.

We left Richmond, BC at 7:30 am yesterday and the traffic was relatively light. I was actually behaving and staying with the flow most of the time because we were talking and having fun along the way. Our pack of maybe 7 or 8 cars got stuck behind a rather slow moving pickup towing an RV for a while in a single lane (per direction) segment of the highway, at one point, the vehicles in front of me were able to pass the RV and I got stuck behind it. I actually attempted to pass once but did not complete it because there were vehicles coming from the opposite direction. If I am in the the aggressive mood and driving my CGTS, I would have passed it already... but this time I patiently stayed behind the big RV trailer but was constantly watching the opposite lane.

At one point - the pickup truck/RV trailer applied it's brake and I thought "damn were slow already and now you're braking, so I made the move to overtake. As I was completing the pass, I notice the flashing red and blue behind me... I stopped and waited for about ten minutes before the RCMP walked out of the patrol car.

He - you're going 129..
Me - I realize that, but sorry Sir, i was just completing the pass.
He - you're 59 over the posted limit, this is a 70 zone.

He pointed to the sign maybe 400 yds in front of us.
Me -I am sorry Sir, I did not notice the 70 sign and thought it is still 110, I sped up a little bit while passing so that I don't get caught by the incoming vehicle
He - No, I have to charge you for excessive speeding and will have to impound your vehicle for 7 days.

Then he walked back and went inside his patrol car. I followed him

Me - Sir, can you please give me a break this time for being a good citizen. You can check my records, I have only one speeding ticket in 1996, and there maybe be other photo radar tickets under our licence plates but they all belong to my wife and my daughter (truth). I won't knowingly drive that fast in town. I must have missed the sign because it was blocked by the RV and I passed it when I was making the move to pass.
He- there are buffer zones 100, then 90 then 70
Me - I did not notice that
He - sorry, I made my reports already and I will be in trouble with my supervisor if I remove it.
Me- can I talk to your supervisor?
He - no, sorry. he is off today
Me- how much is my ticket
He - $ 368, I could easily give you another $368 for wreckless driving but I won't today
Me - thank you, but please don't impound my car. It is almost 4 pm now, we are almost 500 kms away from home and my sister and her kids will have to be at the airport by 4 am tomorrow morning. Can I have my car impounded in Edmonton.
He - No. The tow truck is on the way.
Me - But how will I get home?
He - I can call you a cab which will take you to Jasper, you can rent a car there and you can drive home, but you will have to make your mind quick because the car rental companies will close at 5

He called on phone. Within 5 minutes, the tow truck appeared in front of my vehicle and the taxi appeared behind the patrol car, almost simultaneously.

The taxi driver did not give much time to decide, he said "we are more than 90 kms from Jasper and will have to leave now". So we moved our stuff, turned over my keys to the tow truck and left in the cab.

While on the highway, I talked to the driver quite a bit and when he opened up a bit, I asked him

Me - so, you know this officer really well? Is he a good guy?
Driver - oh yeah, this is a small town (Valemont, BC), everybody know each other really well here.
Me - so, you encounter this situation quite a bit here? Where vehicles get impounded and you have to drive somebody to Jasper?
Driver - oh yeah, average of 5 times a week in the summer.
Me - he must be giving you a lot of business
Driver - I am the only taxi here, and we have only one tow truck here and one lot, so we get to do it all the time. Last week, I had to drive somebody to Kamloops, he paid me $1,200
Me - it surprised me that it happened that often. But you know what - I think he got the wrong guy this time. I know he is just doing his job, but he can do a service to the community if he does something else other than catch somebody making mistakes when the highway speed drops from 100 to 70. I won't knowingly do that and I did not notice. I admit I drive fast occasionally, who don't. But I don't drive recklessly in town.
Driver - I know, but in fairness to him, they put their lives on the line all the time, they arrested 5 guys with loaded guns in the bush earlier today.
Me - how much will you charge me for this trip
Driver- $350 but will take $300 if you pay cash
Me - hmm $350 x 5 times a week average, you make good money from people getting caught alone
Driver - not bad, but you know I have expenses too, like the special licence etc..
Me - I might come by bus to pick up my car next week, will you tell Ryan to give me a ride from the bus depot to the car lot? I will buy him coffee
Driver - I will tell and he might do that, or you could call me. Greyhound arrives here at 2:45 am, I can pick you up at 7am and drive you to the car lot for $40.

Then he gave me his business card and dropped us off at Avis in Jasper. We made it home at 10pm.. not bad

Excessive speeding is a 3 point demerit - happened in another province so not sure if it will affect my insurance premium.

What pisses me off - this is obviously a speed trap. I won't mind all these if I got caught doing 169 in a 110 zone because obviously I am speeding knowingly. But like stated earlier, I got caught doing 129 on a 70 zone at a location before entering a small town along the highway. I admit I drive fast/above posted limits on the highways (who don't), especially when driving my sportier Porsche Cayenne GTS, but I really watch my speed in town and when there are other people/vehicles present.

I googled it up and found out that a lot of drivers get caught by the speed trap in this town, including this story by a lady from a Manitoba.

I have my Escort 9500IX radar detector set at Highway mode all the time (I keep this running all the time even when I don't intend to speed because it breaks the monotony of highway driving and keep me awake) and it went off a number of times during this trip, but never made a single beep this time. I am thinking that the RCMP officer never really clocked me and just read the 129 from the speedometer of his vehicle while he was driving behind me. I am quite sure I was not driving above 110 for a while, and maybe drive 129 at the peak while passing. Somebody told me that in court - the officer has to tell to the judge that he actually clocked the speeder 3 times before he can get a conviction. This could be an illegal charge, that will cost me $2,000 and a lot of inconvenience.

I don't really know the ins and outs of fighting speeding tickets - pls feel free to give your opinion.

I am really pissed off and want to make a lot of noise, but my wife said it is not worth it. Obviously, the RCMP give the local unit a lot of revenues, and the local taxi, towing and impound lot a lot of business. most probably the judge will be from the same small town and friends with them too.
Even if I get my $368 ticket thrown out, I am still out by $1,600.. I hate being a victim of the system. My wife arranged our car rental on the phone, she said the lady in the Avis/Thrifty branch in Jasper told her that this is a regular situation for them.

Some people made comments about the lack of appropriate warning signs in this particular town, If safety is their (real) concern, I am willing to call the local government and highway authority and will be willing to sponsor a couple of big signs to alert drivers to slow down - but I highly doubt the local RCMP unit, towing company and other businesses will appreciate that. I am very tempted to request ATIP inquiry at CIC to find out from RCMP office the real stats. If they are charging a lot of non habitual speeders with excessive speeding in this area - there is obviously something wrong

I don't get the merit of impounding my car, when after incurring a lot of expenses and inconvenience, I could continue driving in a rental car which I am not very familiar with (more risk for me and my family and other travelers)

That is a troubling story. I know that many locales in the US are using traffic citations to help pay for their police forces.

I remember being pulled over in Richmond Hill, just north of Toronto ~12 years ago for speeding. I told him the signs said 100 and I was only doing 80 when he pointed out it is KPH not MPH. Of course I knew but just wanted to see how far the excuse got me ( which wasn't very far :))

I take it you're talking about kph and not mph? years ago I got a ticket in my p-car for exiting the fwy at 130 mph (I was going much faster minutes before), it was 3 AM and the cop was more relieved I was not drunk and reduced the charges to excess speed. the fines weren't too bad plus an add'l 40 hrs of community service, but what it did to my auto premium! my wife and I went from ~$1800/yr in insurance to over $4000 - that lasted three years until it came off my driving record. yeah, I paid for that thrill ride more than once:b

Really sorry to read your story dimfer. FWIW and this may or may not apply to your case, to fight anything in court you have to present reasonable doubt - failure of the radar detector to go off may or may not qualify (for example, if he clocked you with laser, it's hard for detectors to pick that up all the time). Personally, though I have not been ticketed for over 10 years or more, I like to ridicule the police in court, even call them out on their lies (which they will freely invoke); for example, on *estimated* speeds over a limit, I will simply point out that the police quite often do the same on the highway w/o any obvious emergencies, going way over the speed limit+10, referring to various online videos; last time they made that estimated claim (45 in a 30 zone, shortly after starting cold from a red light), I simply pointed out the truth - which is that my car was in second gear when he caught me and the car doesn't reach 45 in that gear. In the same instance, he claimed I was cutting everyone off (to embolden the offense), so I pointed out to him (with pointer finger to his face and a stern voice) that I was the first car at the light, thus cutting no one off. Earlier in my career, a state police officer pissed me off so much with his attitude on site and his lies in court (another speed trap, in this case on a turn at the airport where the speed drops sharply from 35 to 15, and I was indeed going 40 at the corner when I noticed the sign, with no chance to ever slow down) that: a) I called out his lies in court, I asked for his name and he first refused to give it out (they are required by law, and he dismissively pointed me to the ticket), then pointed it out to the judge and he then obliged; 2) I filed a complaint; and 3) have since then been mentioning his name when I get summoned for jury duty and naturally have to recuse myself when the police are the prosecuting party. The reality is that the police are no angels, do in fact often violate the law, and even kill innocent people while driving drunk (see this and this), not to mention other non-traffic related tragedies with innocent victims (the net and youtube are full of such incidents).

So the level of success has been varying, but have always been able to lower the fines, and in two cases, let go.

In US you give $350 to a lawyer who deals with these things and they get rid of it for you. You dont have to do a thing.

This is awful... Seems to me like downright corruption. I'm sure that if investigated, the ties between all these parties (the cop, the taxi driver, the Avis location) might be exposed...

Stuff like that is pretty common in my country, I just never thought I'd hear about it in Canada...

In US you give $350 to a lawyer who deals with these things and they get rid of it for you. You dont have to do a thing.

you must know different lawyers than I do Amir.

Paying the lawyer his fee doesn't get rid of the speeding ticket but rather buys you representation in court.

BTW I don't know any lawyers whose fee is a mere $350 :)

I feel you pain, but look at the positive - if you were a black dude in the deep south you'de be in jail. If you were in Switserland, you'de be looking at a $50,000 ticket (tickets are proportional to income). As it stands, you have to deal with some aggravation, and a some modest financial pain :). Canada ain't so bad.

does this look like a company that has ties with the RCMP :)

If taxi owner is getting 5 similar trips a week, and assuming some people who gets charged with excessive speeding gets picked up by family or friends from there, I won't be surprised to find out that at least one gets excessive speeding ticket in that small town a day.. seems rather high because I don't think people would normally and knowingly drive 40 km/h over posted limit if appropriate warning is posted.. if Excessive Driving consist anywhere near 10% of the total tickets handed out - it smells like a setup and they make sure somebody gets nabbed will require taxi, towing and impounding. Talking about letting the small fish get by and only catching the big one.

Dimfer I feel for you. Here's my story.

The police, state and DMV's are all corrupt at various, maybe not all, but many points in their organizations. About eight years ago, I was driving a rented car from a popular car rental company. Apparently the inspection sticker had expired while I was renting it and I was stopped while going through a checkpoint looking for expired stickers and people not wearing seatbelts in NYC (also corrupt). I told them it was a rented car and even showed them the rental papers I had in the glove box. One cop said to the other, "what do you think?' The partner said to write me up, but not to worry because I should just give the ticket to the rental company. --(TICKETS ARE NOTHING MORE THAN A MONEY MAKING PROPOSITION FOR THE CORRUPT GOVERNMENTS AND THEIR ASSIGNS)-- I told them I didn't want it on my license which was clean. Then, I said, "you mean if the car was parked on the street and a cop drove by and ticketed the car, the rental company would get the ticket in their name, but because I was driving it, the ticket would be in my name?" They said yes!!!! I told them there was something wrong with that logic since it wasn't my car and renters don't check the car stickers when they have a car for a week. I gave the ticket to the rental company and they said it would be taken car of. You would hope that is where the story ended. But that is where the story actually starts.

You guessed it. The rental company never took care of the ticket. Unbeknownst to me, the DMV started sending notices to me at the address on my license where my ex-wife lives. (Don't get my started on the corruption in the divorce industry and court, lawyer and judge corruptions, along with their closed door, judges quarters sessions with lawyers and private deal making that don't include the clients.) I kept that address on my license because I own the house and pay taxes on it and I wanted the benefits of entry to the county parks, etc from that address. Anyway, my ex-wife, usually referred to by an expletive, never told me the DMV sent several letters stating that (1) I owed money for the ticket, (2) for not paying, I had to appear in court and that my license would be suspended if I didn't respond, (3) that there was now a warrant for my arrest for not responding. Now, move ahead about eight months....

On the 55mph highway running through an upstate New York town’s one street, was a cop sitting literally behind the proverbial billboard. I was stopped for speeding in a rinky dink one street town 200 miles from home on my way to visit my daughter at sleep away camp. I gave the cop my license, registration and insurance card and he went back to his car. I thought I was going to get a ticket for speeding, he said 66 in a 55 zone, and be on my way. The cop went back to his car and after a few minutes called out over his PA system told me to turn the car off and slowly drop my keys out my window. He came over with his gun drawn and told me to get out of the car. I’ll add that I was sucking on strong Altoid mints to stay awake on the boring drive in upstate New York and took it out of my mouth and placed it on the floor mat before he got back to my car. The tow truck arrived and I told the cop I put the mint on the floor because I wanted to throw it out. He asked me if I was sure it wasn’t drugs. I asked him if he wanted to smell the mint. He said he didn’t want to smell it, so I threw it out so it wouldn’t melt in the summer heat. Needless to say, I was arrested, put into the back of the police car and never made it to my daughter’s camp. I asked the cop why I was being arrested and the cop said there was a warrant for my arrest, and I asked for what. He said for not appearing in court. I said, for what? He told me I had an outstanding ticket for an expired inspection!!! Now, all the pieces fell into place. So, in addition to the arrest, I got a ticket for speeding, a ticket for driving with a suspended license, and another ticket for aggravated driving with a suspended license (a misdemeanor) related to not appearing in court and driving without a license. I had to call my girlfriend, who has a license, but not a car of her own to pick me up because they wouldn't let me drive my car home. The car was flat-bedded to the police pound, and they kept it on the flat-bed until I walked about two miles ?from the police station to their lot to pay the towing fee ($75-cash). (How else was I going to get there in their rinky dink town?) They searched me and my shoulder bag at the police station. The cop asked if I always keep empty Rolled Gold pretzel bags in my shoulder bag. I was getting annoyed and told him I didn’t want to litter his highway. I posted my own bail--$500-cash, had to pay for the limo to drive my girlfriend to me ($400 on credit card). The cop waited on the road at the edge of town to make sure I wasn’t driving my car home. I now had to hire a lawyer to represent me (in absentia) 200 miles from home ($2500). His fee was tremendously exorbitant for what was probably 10 minutes of talking to the judge and cop during their regular court coffee klotch hours and filing papers that were templates that were in his word processor.

Six months later, all charges were dropped except for the speeding ticket--66 in a 55 zone. I got my bail back two years later. (There’s something wrong with that too.) All this because a NYC cop wanted to show me he was boss and that it was too bad that I was driving a rented car with an expired sticker that should have gone to the rental company, or he could have just let me pass in the first place since it wasn't my car anyway. Why punish the renter for the car rental company's mistake? The police are corrupt, self serving people and don't care about you. All they want is the money. Yeah, I'm still mad about it.

Dimfer I feel for you. Here's my story.

The police, state and DMV's are all corrupt at various, maybe not all, but many points in their organizations. About eight years ago, I was driving a rented car from a popular car rental company. Apparently the inspection sticker had expired while I was renting it and I was stopped while going through a checkpoint looking for expired stickers and people not wearing seatbelts in NYC (also corrupt). I told them it was a rented car and even showed them the rental papers I had in the glove box. One cop said to the other, "what do you think?' The partner said to write me up, but not to worry because I should just give the ticket to the rental company. --(TICKETS ARE NOTHING MORE THAN A MONEY MAKING PROPOSITION FOR THE CORRUPT GOVERNMENTS AND THEIR ASSIGNS)-- I told them I didn't want it on my license which was clean. Then, I said, "you mean if the car was parked on the street and a cop drove by and ticketed the car, the rental company would get the ticket in their name, but because I was driving it, the ticket would be in my name?" They said yes!!!! I told them there was something wrong with that logic since it wasn't my car and renters don't check the car stickers when they have a car for a week. I gave the ticket to the rental company and they said it would be taken car of. You would hope that is where the story ended. But that is where the story actually starts.

You guessed it. The rental company never took care of the ticket. Unbeknownst to me, the DMV started sending notices to me at the address on my license where my ex-wife lives. (Don't get my started on the corruption in the divorce industry and court, lawyer and judge corruptions, along with their closed door, judges quarters sessions with lawyers and private deal making that don't include the clients.) I kept that address on my license because I own the house and pay taxes on it and I wanted the benefits of entry to the county parks, etc from that address. Anyway, my ex-wife, usually referred to by an expletive, never told me the DMV sent several letters stating that (1) I owed money for the ticket, (2) for not paying, I had to appear in court and that my license would be suspended if I didn't respond, (3) that there was now a warrant for my arrest for not responding. Now, move ahead about eight months....

On the 55mph highway running through an upstate New York town’s one street, was a cop sitting literally behind the proverbial billboard. I was stopped for speeding in a rinky dink one street town 200 miles from home on my way to visit my daughter at sleep away camp. I gave the cop my license, registration and insurance card and he went back to his car. I thought I was going to get a ticket for speeding, he said 66 in a 55 zone, and be on my way. The cop went back to his car and after a few minutes called out over his PA system told me to turn the car off and slowly drop my keys out my window. He came over with his gun drawn and told me to get out of the car. I’ll add that I was sucking on strong Altoid mints to stay awake on the boring drive in upstate New York and took it out of my mouth and placed it on the floor mat before he got back to my car. The tow truck arrived and I told the cop I put the mint on the floor because I wanted to throw it out. He asked me if I was sure it wasn’t drugs. I asked him if he wanted to smell the mint. He said he didn’t want to smell it, so I threw it out so it wouldn’t melt in the summer heat. Needless to say, I was arrested, put into the back of the police car and never made it to my daughter’s camp. I asked the cop why I was being arrested and the cop said there was a warrant for my arrest, and I asked for what. He said for not appearing in court. I said, for what? He told me I had an outstanding ticket for an expired inspection!!! Now, all the pieces fell into place. So, in addition to the arrest, I got a ticket for speeding, a ticket for driving with a suspended license, and another ticket for aggravated driving with a suspended license (a misdemeanor) related to not appearing in court and driving without a license. I had to call my girlfriend, who has a license, but not a car of her own to pick me up because they wouldn't let me drive my car home. The car was flat-bedded to the police pound, and they kept it on the flat-bed until I walked about two miles ?from the police station to their lot to pay the towing fee ($75-cash). (How else was I going to get there in their rinky dink town?) They searched me and my shoulder bag at the police station. The cop asked if I always keep empty Rolled Gold pretzel bags in my shoulder bag. I was getting annoyed and told him I didn’t want to litter his highway. I posted my own bail--$500-cash, had to pay for the limo to drive my girlfriend to me ($400 on credit card). The cop waited on the road at the edge of town to make sure I wasn’t driving my car home. I now had to hire a lawyer to represent me (in absentia) 200 miles from home ($2500). His fee was tremendously exorbitant for what was probably 10 minutes of talking to the judge and cop during their regular court coffee klotch hours and filing papers that were templates that were in his word processor.

Six months later, all charges were dropped except for the speeding ticket--66 in a 55 zone. I got my bail back two years later. (There’s something wrong with that too.) All this because a NYC cop wanted to show me he was boss and that it was too bad that I was driving a rented car with an expired sticker that should have gone to the rental company, or he could have just let me pass in the first place since it wasn't my car anyway. Why punish the renter for the car rental company's mistake? The police are corrupt, self serving people and don't care about you. All they want is the money. Yeah, I'm still mad about it.

I feel for your plight. Did your lawyer not have recourse to file suit against the car rental company

You know, Steve, I never even thought about suing the rental company.

I was just glad to finally have the whole affair done.

you must know different lawyers than I do Amir.

Paying the lawyer his fee doesn't get rid of the speeding ticket but rather buys you representation in court.

BTW I don't know any lawyers whose fee is a mere $350 :)
No, it buys you everything Steve. The way it works is that they have an arrangement where the prosecutor deals with a collection of cases they have as to save time and money for more serious offenses. Ability to dismiss the case depends on which county you are in to some extent. In the case of my son who had speeding ticket, we paid the money and it was all taken care of, including waving of the ticket itself. We broke even on that but with no point on his license or increase in insurance. We didn't have to do a thing but fill out a form the lawyer has. She took care of the rest.

Adding on, I too was surprised about the relatively low fee as lawyers go. My sense is that though they deal with volume here, handing dozens of cases all at once.

I think you're too harsh on the cops here. "...... The partner said to write me up, but not to worry because I should just give the ticket to the rental company......". They probably genuinely thought this would not impact you, they have no one else they can write the ticket to, and waiving the ticket was not in the cards (you were a hot bimbo after all).

To me the, the negligence prize here goes to the rental company (renting a car with expired tag, and failing to pay the fine), and the *******/bitch prize goes to the ex-wife (failure to forward your mail).

Sorry to hear of this, Dimfer. Your rant was well received and I can empathize with you wholeheartedly. I do what you did all of the time and have yet to receive a ticket, much less be pulled over for questioning. The whole story wreaks highly of corruption (to me). Cops around here on the highways routinely pass me going 10 over like I was going 10 under. In town, drive like a granny and they will leave you alone even if you block them while running a red light (seen that happen WAY too many times). They just drive off like nothing happened.

Sounds like some folks are making bank and just cashed you in.
